Circumstances

The facts around an act that settle what it meant. Terms are what the parties stated; circumstances are what both already knew. Circumstances add nothing to a deal and remove nothing from it -- they only fix the meaning of the words and Conduct the parties used. They never supply a Consent that no word and no Conduct carried. Whether a circumstance held is a question of Evidence, and a Judgment that rests on it stays falsifiable like any other.
